This Returns and Refunds Policy (the “Policy”) applies to all purchases made through the Website operated by FLYPER S.r.l. and forms an integral part of the Terms and Conditions of Sale.
This Policy applies to Customers purchasing Products as consumers for personal use.
Nothing in this Policy shall affect the Customer’s mandatory rights under applicable consumer protection laws, including Directive 2011/83/EU and Directive (EU) 2019/771 as implemented under Italian law.
Right of Withdrawal
In accordance with applicable European and Italian consumer protection laws, Customers have the right to withdraw from the purchase contract within fourteen (14) days from the day on which they, or a third party designated by them other than the carrier, acquire physical possession of the Products.
To exercise the right of withdrawal, the Customer must send a clear communication to the Company using the contact details indicated at the end of this Policy.
The Customer must return the Products within fourteen (14) days from the date on which the withdrawal was communicated.
The Company shall bear the cost of return shipping for valid withdrawals exercised in accordance with this Policy.
Return Conditions
Returned Products must:
- be in their original condition;
- be returned in their original packaging;
- include all accessories, cases, cloths, and documentation;
- show no signs of use beyond what is necessary to inspect the Products.
The Customer shall be liable for any diminished value of the Products resulting from handling beyond what is necessary to establish their nature, characteristics and functioning, in accordance with applicable law.
The Company reserves the right to refuse returns that appear abusive, excessive, or inconsistent with normal consumer use.
The Company reserves the right to refuse returns where the Product has been damaged, altered, or used in a manner inconsistent with normal inspection.
Return Procedure
Before returning any Product, the Customer must contact the Company using the contact details indicated at the end of this Policy and request return instructions.
The Company may provide a return authorization or shipping instructions to facilitate the return process.
The absence of a return authorization shall not affect the Customer’s statutory right of withdrawal but may delay processing.
Refunds
Once the returned Product has been received and inspected, the Company shall notify the Customer whether the refund has been approved.
If approved, the refund shall be processed without undue delay and in any event within fourteen (14) days from receipt of the returned Product or proof of return shipment.
Refunds shall be issued using the same payment method used for the original purchase, unless otherwise required by law.
Any delays caused by payment service providers or banking systems are outside the Company’s control.
Defective or Non-Conforming Products
Products that are defective or non-conforming are covered by the legal guarantee of conformity described in the Terms and Conditions of Sale.
Where a Product is confirmed to be defective or non-conforming, the Company shall, in accordance with applicable law:
- repair or replace the Product; or
- issue a refund where repair or replacement is not possible or proportionate.
In such cases, the Company shall bear all reasonable return and shipping costs.
If a Product is received damaged, the Customer must notify the Company without undue delay and provide supporting evidence where reasonably requested.
The Company shall investigate the claim and, where appropriate, provide a replacement or refund.
Exclusions
This Policy does not apply where:
- the Product has been damaged due to misuse or negligence;
- normal wear and tear has occurred;
- the Product has been modified or repaired by unauthorized parties.
